Bryan D. McQuaid, 37, Gallipolis was sentenced to four years in prison by Gallia County Court of Common Pleas Judge Margaret Evans after pleading guilty to an amended charge of attempted rape. McQuaid had been indicted and charged with rape during the January session of the Gallia County Grand Jury following his arrest by the Gallipolis Police Department.
During sentencing, the Court found McQuaid has a history of criminal convictions, including two prior convictions of domestic violence and has not responded favorably to sanctions previously imposed. According to court documents, McQuaid has been on probation 10 times in the Gallipolis Municipal Court with four violations and exhibits a pattern of drug abuse and a refusal to engage in treatment.
McQuaid was subsequently sentenced to the Ohio Department of Rehabilitation and Corrections for a period of four years with two years being mandatory. Upon release, McQuaid will be placed on three years post release control by the Ohio Adult Parole Authority.
Also recently sentenced to prison was:
Derrick J. Ward, 56, Gallipolis, pleaded guilty to felony OVI, with a specification that Ward had been convicted of or pleaded guilty to five or more violations in the previous 20 years of committing the offense. Ward was sentenced to one year in prison for the specification and 36 months community control for felony OVI following his release from prison.
In addition, a $1,350 fine plus a $100 fine for scrapped vehicle were imposed. As a part of his community control sentence, Ward will be required to serve 90 days in either jail or work release, comply with 180 days of SAM, submit and successfully complete, if required, Moral Reconation Training, as well as submit to a substance abuse and mental health evaluation and follow-up treatment. Ward will also be under intensive reporting requirements.
Other cases recently resolved with community control or CBCF commitment were:
Nicholas R. Bailey, 25, Gallipolis, pleaded guilty to possession of heroin and aggravated possession of fentanyl and was sentenced to 24 months community control.
Jesse L. Partlow, 29, Gallipolis, pleaded guilty to aggravated possession of drugs and possession of drugs and was sentenced to 24 months community control.
Marzella K. Depasquale, 24, Vinton, who was previously granted treatment in lieu of conviction of telecommunications fraud pleaded guilty to telecommunications fraud after reportedly violating community control sanctions and was sentenced to 36 months community control.
Joseph A. Collins, 34, Gallipolis, pleaded guilty to aggravated possession of drugs and was sentenced to 24 months community control.
James R. Kinnison, Jr., 38, Bidwell, pleaded guilty to theft and safecracking and was sentenced to 24 months community control. Kinnison was also ordered to pay $3,000 in restitution.
Angel Marie Myers, 40, Gallipolis, pleaded guilty to assault and was sentenced to 24 months community control.
